1. Acceptance of Terms

Welcome to RocketCore.AI. These Terms of Service (“Terms”) govern your access to and use of the websites, products, services, and applications (collectively, the “Services”) provided by RocketCore.AI (“Company,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

These Terms apply to all users of the Services, including without limitation users who are browsers, customers, merchants, vendors, and contributors of content. By using any of our Services, including but not limited to RocketLaunch, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Services

RocketCore.AI provides AI-powered business automation and lead generation solutions designed for small and medium-sized businesses. Our Services may include, but are not limited to:

  • AI-powered lead capture and qualification tools
  • SMS and text messaging campaigns
  • Automated missed-call text-back functionality
  • Web chat widgets and conversational AI assistants
  • Social media monitoring and reputation management
  • Appointment scheduling and calendar integration
  • Analytics and reporting dashboards
  • Multi-location and team management tools

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. Account Registration and Security

To access certain features of the Services, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. RocketCore.AI will not be liable for any loss or damage arising from your failure to protect your account information.

4. Permitted Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates any applicable federal, state, local, or international law or regulation, including without limitation laws regarding the transmission of unsolicited commercial messages (e.g., the Telephone Consumer Protection Act, CAN-SPAM Act, and applicable state laws).
  • Send, or facilitate the sending of, any unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation through the Services.
  • Impersonate or attempt to impersonate RocketCore.AI, a RocketCore.AI employee, another user, or any other person or entity.
  • Engage in any conduct that restricts or inhibits any other user from using or enjoying the Services, or which may harm RocketCore.AI or its users.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, servers, or databases connected to the Services.
  • Use the Services to collect, store, or process personal information of third parties without their proper consent.

5. SMS and Messaging Compliance

If you use any messaging features of the Services, including SMS campaigns, missed-call text-back, or automated messaging, you agree to comply with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable FCC regulations and carrier guidelines.

You specifically agree to:

  • Obtain proper express written consent from all recipients before sending any marketing or promotional text messages through the Services.
  • Maintain records of all consent obtained from message recipients.
  • Include clear opt-out instructions in every message sent through the Services and honor all opt-out requests promptly.
  • Not send messages to any numbers listed on the National Do Not Call Registry without prior express consent.
  • Comply with all applicable message frequency and content requirements.

You acknowledge and agree that you are solely responsible for ensuring compliance with all messaging laws and regulations. RocketCore.AI provides tools to assist with compliance but does not guarantee compliance on your behalf. Any fines, penalties, or legal actions resulting from your non-compliance are your sole responsibility.

6. Intellectual Property Rights

The Services and their entire contents, features, and functionality, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by RocketCore.AI, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes, subject to these Terms. This license does not include the right to sublicense, resell, distribute, or make the Services available to any third party, or to modify, adapt, translate, reverse-engineer, decompile, or disassemble the Services or any portion thereof.

7. User Content

You retain ownership of any content, data, or materials you upload, submit, or transmit through the Services (“User Content”). By submitting User Content, you grant RocketCore.AI a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process your User Content solely for the purpose of providing and improving the Services.

You represent and warrant that you own or have the necessary rights and permissions to submit your User Content and that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

8. Payment Terms

Certain Services may be offered on a subscription or pay-per-use basis. By subscribing to or purchasing a paid Service, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable unless otherwise stated in writing or required by applicable law.

RocketCore.AI reserves the right to change its pricing at any time. If you are on a subscription plan, price changes will take effect at the start of your next billing cycle. We will provide reasonable advance notice of any price increases.

If payment is not received or a charge is declined, we reserve the right to suspend or terminate your access to the paid Services until payment is resolved.

9. Free Trials

RocketCore.AI may offer free trial periods for certain Services. At the end of a free trial, your account may be automatically converted to a paid subscription unless you cancel before the trial period ends. We will notify you of the terms and timing of any such conversion at the start of the trial.

10. Third-Party Services and Integrations

The Services may integrate with or contain links to third-party websites, services, or applications (“Third-Party Services”), including but not limited to telecommunications providers, calendar services, social media platforms, and payment processors. RocketCore.AI does not control, endorse, or assume responsibility for any Third-Party Services. Your use of Third-Party Services is governed by their respective terms and policies.

You acknowledge that RocketCore.AI is not responsible for the availability, accuracy, or content of Third-Party Services, nor for any loss or damage caused by your use of or reliance on such services.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

12. Disclaimers

The Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. RocketCore.AI disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

RocketCore.AI does not warrant that the Services will be uninterrupted, timely, secure, or error-free, that the results obtained from the use of the Services will be accurate or reliable, or that any defects in the Services will be corrected.

RocketCore.AI does not guarantee any specific results from the use of the Services, including but not limited to lead generation, customer acquisition, or revenue increases.

13. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall RocketCore.AI, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; or (d) unauthorized access, use, or alteration of your transmissions or content.

In no event shall RocketCore.AI’s total liability to you for all claims arising out of or relating to these Terms or the Services exceed the amount you have paid to RocketCore.AI in the twelve (12) months immediately preceding the event giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless RocketCore.AI and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or consumer protection right; (d) any User Content you submit through the Services; or (e) any messages sent through the Services on your behalf.

15. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by contacting us or by using the account cancellation feature within the Services. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Nebraska, and you consent to the personal jurisdiction of such courts.

17. Changes to Terms

RocketCore.AI reserves the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least thirty (30) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and RocketCore.AI regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
